We have no historical background, experience in the jury trial system. Despite the short time, and the citizen participation trial system has been successfully established. Now it has to go beyond the activation step, not settled step.
Through implementation and analysis over the past five years it has caused a lot of problems. And under this reflects amendment is pending in the National Assembly. The final form of citizen participation trial is not possible to predict whether a trial is modified in any form in the consultation process of the National Assembly. But look at the main items of the final form, despite many problems, many people are sympathetic to activate the jury trial system.
Meanwhile, the jury trial system has made human and material supplement. If so, we need the active interest and participation of citizens in jury trial system subject of the trial activation. Because the success of jury trial system is that the active interest and participation of the public it is essential.
I suggested a few measures for the active interest and participation of the people to the jury trial system. These measures have to be practical. So it could go beyond the settlement phase advance to the active phase. It is because the introduction for the democratization of the national judicial and law enforcement participation. So now it is necessary. "Why the jury trial system is introduced.“, ”What is the purpose of it.“ Once again we should consider. Furthermore, we should be able to implement more faithfully the purposes of jury trial system, especially in the criminal justice system. When the ’Korean jury trial system model’ could be confirmed, the jury trial system would be activated.
